LEGISLATION
IT’S THE LAW
HIPAA

The Health Insurance Portability and Accountability Act:  A federal law enacted to protect the privacy of individually identifiable health information.  HIPAA lists shredding as a specific example of how to protect patient confidentiality.  In February of 2009, the American Recovery and Reinvestment Act (ARRA) made an amendment to HIPAA which is know as HITECH (Health Information Technology for Economic and Clinical Health).  Fully effective in February 2010, it significantly increased data protection liabilities for all health-related organizations.

Grahamm-Leach Bliley Act of 1999

This law dictates that each financial institution must protect customers’ non-public information by establishing safeguards to “insure the security and confidentiality of customer records and information.

FACTA: The Fair and Accurate Credit Transaction Act, June 2005

Requires virtually all businesses to destroy documents with consumer information prior to disposal.  Acceptable methods of disposal include shredding, burning or pulverizing.  It is no longer legal to simply throw consumer information in the trash.  Enforced in  December of 2010,  FACTA was updated with the Red Flag Rule which is  an anti-fraud regulation, requiring creditors and financial institutions with covered accounts to execute mechanisms to identify, detect, and respond to the warning signs, or ‘red flags,’ that could signify identity theft.

The Identity Theft Protection Act of 2005, December 2005

This North Carolina law mandates all businesses possessing personal information of a NC resident must take measures to protect that information even after its disposal.  Measures cited in the law include shredding of papers beyond reconstruction.  The law also requires the implementation and monitoring of written document protection and destruction policies.
